Child Custody Cases

A couple needs to decide Child Custody when they, as parents, decide to put an end to their relationship through an annulment or divorce – both of which are final means of ending or dissolving a union under the law. Child Custody references practical and legal rights over a minor child. Several countries follow the legalities put forward by the United Nations Convention on the Rights of a Child.

One of the best known films that depict a conflict regarding child custody has to be Robert Benton’s 1979 film Kramer vs. Kramer which was based on the book of the same name by Avery Corman. The film portrays Joanna Kramer – played by Meryl Streep, frustrated by her housewife role and taking care of her son, Justin Henry, abandoning her husband Ted Kramer – played by Dustin Hoffman – in order to explore and find her ‘self’.

Because of Joanna’s fleeing to New York, Ted is forced to raise son Justin Henry on his own and although his initial instinct is to continue to work – he’s a workaholic, which was one of the driving forces behind Joanna’s leaving him – he ultimately involves himself in the childcare his son needs and it becomes so consuming, he loses his job because he’s neglected it.

Enter Joanna again, back from her two years in New York. She launches an expensive legal battle over Justin Henry’s custody; though, in the end, Joanna realizes that Justin Henry’s ideal life is with his father and she retreats.

During a child custody rights case, parents make a variety of assertions about themselves and accusations against their former spouse or partner. False allegations of child sexual abuse, financial and educational incompetency made against one another by parents are not uncommon.

A real-life case involving a woman and her daughter in 1994 in which the judge ruled against the woman, Jennifer Ireland, in the battle for her child’s custody became headline news. The judge in the Ireland case deemed the woman was unfit because of the fact that Ireland had to place her four-year-old daughter in day care because of her work. An attorney from Michigan, Julie Kunce Field, fought her case and attracted national attention. In 1995, the ruling was overturned and given in favor of Ireland because a parent’s child care methods were dropped from child care custody cases.

Britney Spears, the troubled pop star, finally lost her long and drawn out child custody battle for her two young sons to ex-husband Kevin Federline who won custody while Spears only received visitation rights. Spears was accused of negligence while driving with the children, alcohol abuse and reckless behavior in public.

As a parent or attorney, the most important thing to keep in mind is that psychologists analyzing the case and the jury all do so in the child’s best interest. Although sole custody is a viable possibility, in the majority of cases, the legal system grants joint custody of the minor child to both parents.
